It's time for House Democrats to step up and lead. Senate Republicans and turncoat Democrat Sen. Joe Manchin just confirmed Brett Kavanaugh to the Supeme Court – but House members have the power to impeach him. Kavanaugh has been credibly accused of sexual assault and lying under oath in 2004, 2006 and at least 30 times during his Supreme Court confirmation hearings.1 Perjury is an impeachable offense. Senate Republicans have proven that they care more about helping men escape consequences for sexual harassment and assault than about making sure a liar and potential sexual predator isn't confirmed to the Supreme Court. House Republicans should be feeling massive pressure demanding they do better than their Senate colleagues. House Democrats have a role to play too. A few weeks ago, progressive champion Rep. Ted Lieu called for impeachment and a House Judiciary Committee investigation.2 Rep. Jerrold Nadler, who is in line to chair the committee, just said he would conduct a real investigation into the allegations against Kavanaugh and hold him accountable if Democrats take control of the House this November.3 Every House member should be supporting this plan but, some are already backing away. House Minority Leader Nancy Pelosi recently said that impeachment is off the table.4 If we want accountability for Kavanaugh, we need to keep pushing. We must join together now and make clear to Rep. Tell Sens. Heitkamp and Manchin: Oppose Kavanaugh

Joe Donnelly, Claire McCaskill and John Tester have found their backbones and voiced their opposition to Brett Kavanaugh, but not Sens. Heidi Heitkamp or Joe Manchin.1 Dr. Christine Blasey Ford's brave, credible testimony and Kavanaugh's unhinged denials should be enough for any senator to vote no, but Sens. Heitkamp and Manchin are trying to hedge their bets and avoid angering Trump supporters in their states by refusing to oppose Kavanaugh. It's unacceptable. Any Democrat who helps Republicans advance Kavanaugh's nomination would be betraying survivors and all of us who refuse to institutionalize Trump's extremism on the Supreme Court for a generation. With Senate Majority Leader Mitch McConnell pushing for a final vote by as soon as Saturday, it's time for massive pressure demanding that Sens. Earlier this week, nine West Virginians were arrested for sitting in at one of Manchin's campaign offices after he said that he would wait for the completion of the FBI investigation before deciding how to vote.3 It's an outrageous stance. The FBI failed to interview more than 24 potential witnesses, including Dr. Blasey Ford and others who sought to provide their stories.4 Its report, which Senators now have, clearly lets Kavanaugh off the hook and gives cover to Senators who will vote to confirm him.5 It is crucial that we pressure undecided senators – especially Democrats – to rely on what we already know about Kavanaugh and not only on what the FBI produced. Even without an investigation, Kavanaugh's false statements, his evasions, vile rants and partisan threats, and his record on women, workers, the environment and executive power disqualify him. And beyond the national stakes, there are state-level risks as well. If Sen. Manchin joins Republicans to confirm Kavanaugh and Kavanaugh overturns the ACA, West Virginia would be the most adversely affected state.6 North Dakota would also be hard hit if Kavanaugh were confirmed. Sen. Heitkamp has been quick to criticize her Senate challenger Kevin Cramer for demeaning Dr. Christine Blasey Ford, but she still has not said she opposes Kavanaugh. Tell Sen. Flake: Brett Lied Under Oath, He's Disqualified

It's time for Sen. Jeff Flake to back up his words with action. Last week, Sen. Flake forced his fellow Republicans to slow down Brett Kavanaugh's confirmation to make time for an FBI investigation. Since then, he has twice stated that if Kavanaugh lied to the committee, he cannot be confirmed to the Supreme Court. But we already know that Kavanaugh lied to the committee – repeatedly. Dr. Ford's brave and credible testimony and Kavanaugh's unhinged denials should be enough for any senator to vote no, but if Sen. Flake is concerned about other lies, there are plenty to choose from. Kavanaugh's false statements, along with his evasions, vile rants and partisan threats, made it clear he is not qualified to serve as a Supreme Court Justice. If lying is disqualifying, Sen. Several organizations have compiled Kavanaugh's false and questionable statements to the Senate Judiciary Committee going all the way back to his 2004 and 2006 confirmation hearings.1 But even just in last Thursday's hearing, Kavanaugh lied repeatedly: Kavanaugh said he first heard about Deborah Ramirez's allegations when the New Yorker published them on Sept. 23. But text messages show that Kavanaugh and his team were trying to refute Ramirez’s allegations before they became public.2 Kavanaugh claimed to have “no connections” to Yale, explaining that “I got there by busting my tail.” But Kavanaugh’s grandfather attended the school, giving him an advantage as a legacy student under Yale's admissions policies.3 Kavanaugh said that he and Dr. Ford did not travel in the same social circles. But Dr. Ford dated Kavanaugh's friend Chris Garrett (aka Squi), who Kavanaugh mentioned repeatedly in his testimony, in the summer of 1982.4 Kavanaugh said that none of the gatherings on his calendar included the group of people that Dr. Ford identified. But a July 1 calendar entry included the same people that Dr. Ford said attended the gathering.5 Kavanaugh claimed that "[a]ll the witnesses who were there say it didn’t happen." But Dr. Ford's friend Leland Keyser, one of those Dr. Ford says was present, said she believes Dr. Ford's allegation.6 These lies matter. Each one undermines Kavanaugh's denials of the multiple sexual assault claims against him. Each one calls into question his trustworthiness and his ability to be an impartial and honest jurist. Because lying under oath is an impeachable offense, the lies also open Kavanaugh up to blackmail by anyone who could expose him, a risk that FBI agents are supposed to assess during background checks. Sen. Flake has said twice that lying is disqualifying. When asked on "60 Minutes" whether Kavanaugh's nomination would end if he lied to the Senate Judiciary Committee, Flake said, "Oh, yes."7 On Monday, he again said that if Flake “lied on particular things that is demonstrable, then that is disqualifying.”8 Sen. Flake needs to decide. He can be a leader who acts on his principles, or he can prove yet again that when it's time to offer more than speeches and platitudes, he flakes. Tell Sen. Yesterday Progress Now Arizona visited Senator Jeff Flake's office to remind him to live up to his principles and vote no on confirming Kavanaugh to the Supreme Court. 

We have to keep up the pressure this week.

That's why we're collecting 100 personal messages from Arizonans to Senator Jeff Flake about the Kavanaugh nomination. We are particularly looking to collect messages from women and survivors, as well as queer, trans and gender non-conforming people.
