It's time for House Democrats to step up and lead. Senate Republicans and turncoat Democrat Sen. Joe Manchin just confirmed Brett Kavanaugh to the Supeme Court – but House members have the power to impeach him. Kavanaugh has been credibly accused of sexual assault and lying under oath in 2004, 2006 and at least 30 times during his Supreme Court confirmation hearings.1 Perjury is an impeachable offense. Senate Republicans have proven that they care more about helping men escape consequences for sexual harassment and assault than about making sure a liar and potential sexual predator isn't confirmed to the Supreme Court. Earlier this week, nine West Virginians were arrested for sitting in at one of Manchin's campaign offices after he said that he would wait for the completion of the FBI investigation before deciding how to vote.3 It's an outrageous stance. The FBI failed to interview more than 24 potential witnesses, including Dr. Blasey Ford and others who sought to provide their stories.4 Its report, which Senators now have, clearly lets Kavanaugh off the hook and gives cover to Senators who will vote to confirm him.5 It is crucial that we pressure undecided senators – especially Democrats – to rely on what we already know about Kavanaugh and not only on what the FBI produced. Even without an investigation, Kavanaugh's false statements, his evasions, vile rants and partisan threats, and his record on women, workers, the environment and executive power disqualify him. And beyond the national stakes, there are state-level risks as well. If Sen. Manchin joins Republicans to confirm Kavanaugh and Kavanaugh overturns the ACA, West Virginia would be the most adversely affected state.6 North Dakota would also be hard hit if Kavanaugh were confirmed. It's time for Sen. Jeff Flake to back up his words with action. Last week, Sen. Flake forced his fellow Republicans to slow down Brett Kavanaugh's confirmation to make time for an FBI investigation. Since then, he has twice stated that if Kavanaugh lied to the committee, he cannot be confirmed to the Supreme Court. But we already know that Kavanaugh lied to the committee – repeatedly. Dr. Ford's brave and credible testimony and Kavanaugh's unhinged denials should be enough for any senator to vote no, but if Sen. Flake is concerned about other lies, there are plenty to choose from. Kavanaugh's false statements, along with his evasions, vile rants and partisan threats, made it clear he is not qualified to serve as a Supreme Court Justice. If lying is disqualifying, Sen. Several organizations have compiled Kavanaugh's false and questionable statements to the Senate Judiciary Committee going all the way back to his 2004 and 2006 confirmation hearings.1 But even just in last Thursday's hearing, Kavanaugh lied repeatedly: Kavanaugh said he first heard about Deborah Ramirez's allegations when the New Yorker published them on Sept. 23. But text messages show that Kavanaugh and his team were trying to refute Ramirez’s allegations before they became public.2 Kavanaugh claimed to have “no connections” to Yale, explaining that “I got there by busting my tail.” But Kavanaugh’s grandfather attended the school, giving him an advantage as a legacy student under Yale's admissions policies.3 Kavanaugh said that he and Dr. Ford did not travel in the same social circles. But Dr. Ford dated Kavanaugh's friend Chris Garrett (aka Squi), who Kavanaugh mentioned repeatedly in his testimony, in the summer of 1982.4 Kavanaugh said that none of the gatherings on his calendar included the group of people that Dr. Ford identified. But a July 1 calendar entry included the same people that Dr. Ford said attended the gathering.5 Kavanaugh claimed that "[a]ll the witnesses who were there say it didn’t happen." But Dr. Ford's friend Leland Keyser, one of those Dr. Ford says was present, said she believes Dr. Ford's allegation.6 These lies matter. Each one undermines Kavanaugh's denials of the multiple sexual assault claims against him. Each one calls into question his trustworthiness and his ability to be an impartial and honest jurist. Because lying under oath is an impeachable offense, the lies also open Kavanaugh up to blackmail by anyone who could expose him, a risk that FBI agents are supposed to assess during background checks. Sen. Flake has said twice that lying is disqualifying. When asked on "60 Minutes" whether Kavanaugh's nomination would end if he lied to the Senate Judiciary Committee, Flake said, "Oh, yes."7 On Monday, he again said that if Flake “lied on particular things that is demonstrable, then that is disqualifying.”8 Sen. Flake needs to decide. He can be a leader who acts on his principles, or he can prove yet again that when it's time to offer more than speeches and platitudes, he flakes. Tell Sen. My letter regarding Christine Blasey Ford's male interrogators on the Senate Judiciary Committee

Christine Blasey Ford will likely face intense questioning from Republicans on the Senate Judiciary Committee about the truthfulness of her accusations against Brett Kavanaugh, the Supreme Court nominee, who she says attempted to rape her during a party in the 1980s. Her turn on Capitol Hill could decide Kavanaugh’s suddenly uncertain fate, as well as the Supreme Court’s direction for a generation.1

Christine Ford will face questions from 11 Republican MEN on the Senate Judiciary Committee.

I just sent the following message to Sen. Senator Jeff Flake:

Dear Senator Flake,

It is bad enough that there are only Republican men on the Senate Judiciary Committee - especially since the issue of women's reproductive rights is at stake. Those men will never understand the prospect of risking their lives to have a baby or a back alley abortion. They will never face the threat of losing their livelihood because they become pregnant. If they did, they would not vote to allow insurance companies to stop paying for the pill or support bills that allow companies to fire pregnant women - like several congressmen have.

Senator Flake, it is entirely inappropriate that Christine Blasey Ford face intense questioning from eleven men on the Senate Judiciary Committee about the truthfulness of her accusations that Brett Kavanaugh attempted to rape her. Men cannot begin to understand the sexual trauma Ford claims to have suffered at Kavanaugh’s hands, or how that trauma has affected her throughout her adult years. Senator Hatch has already dismissed Ford as potentially “mixed up” in the charges she’s made.

It is clear that Republicans on the Senate Judiciary Committee knew about, and prepared for the fallout from, Blasey Ford's allegations. But instead of acting on such obviously disqualifying information, they rushed through Kavanaugh's nomination and buried key documents that could shed further light on his character.

We already have an accused sexual predator in the White House. We don't need another one on the Supreme Court. Nor should the Senate hand over the Court to a criminal co-conspirator who may have helped a foreign government steal the 2016 election and whose dangerous agenda includes ripping children from their families, taking away women's rights, banning Muslims from the country, undermining LGBTQ equality and destroying the planet.

Despite the allegations against Kavanaugh, the White House has indicated it is "full steam ahead" on his nomination.2 This refusal to slow things down in the face of Blasey Ford's courage proves yet again that the Republican Party is willing to ignore, demonize and undermine women in service of partisan gain. Confirmation hearings for Brett Kavanaugh’s nomination to the Supreme Court begin today, despite the fact that senators still don’t have complete records from Kavanaugh’s time as staff secretary under former president George W. Bush. And frankly, that’s just one of the way too many reasons why it’s absurd that these hearings are proceeding. From the aforementioned secrecy around key aspects of Kavanaugh’s professional past to the fact that the person nominating him, Donald Trump, is an unindicted co-conspirator in a felony, there’s really no good reason the Senate should even be considering installing Brett Kavanaugh on our highest court.

The things we do know about Kavanaugh – including his hostility to women’s reproductive rights and health, his disregard for workers’ rights and safety, and his willingness to give a sitting president carte blanche to flout the law – are the reasons we’ve spent our summer opposing him, including during our Justice Rising week of action last month. And if these hearings are going to proceed, we’re going to be there every step of the way, checking every attempt to dodge tough questions and helping you hold your senators accountable for supporting Kavanaugh.

How to stand up to Trump Collusion and oust Kavanaugh

This Week in Trump Collusion” timeline:

→ Tuesday: Former Trump campaign chairman Paul Manafort was found guilty on charges of bank and tax fraud. THEN former Trump attorney Michael Cohen pled guilty to campaign finance violations.
→ Wednesday: The revelations on the Cohen investigation prompted Democrats to call for a delay on the confirmation process for Trump’s Supreme Court nominee Brett Kavanaugh. And New York state investigators issued a subpoena to Cohen as part of their investigation into the Trump Foundation.
→ Thursday: We found out that National Enquirer publisher David Pecker received immunity from federal prosecutors for providing information on the Trump and Cohen hush money investigations. After Trump threw a Twitter tantrum, and called Paul Manafort a “brave man,” it was reported that Trump is considering a pardon for Manafort (reminder: this is a big, glaring red line and we’ll be ready).
→ Hours before we wrote this email: News broke that Trump organization finance chief, Allen Weisselberg, would be granted immunity in the Cohen investigation as well.

Bottom line: Even before the continuing drip-drip of collusion, there were plenty of reasons for your senators to oppose Kavanaugh based on his record.

Brett Kavanaugh's record shows that he is willing to protect Trump from accountability for his corruption and crimes, dismantle environmental protections, and side with the wealthy and powerful over working people. 

Now, there’s no excuse for inaction. We know that Brett Kavanaugh does not believe a sitting president can be indicted, or should even be investigated. It’s clear that Trump engaged in criminal activity during the campaign, and he chose Kavanaugh in order to shield himself from accountability when the Supreme Court inevitably weighs in on Trump’s crimes and corruption.

That’s why it is imperative that we stop Kavanaugh now. Trump has hand-picked the Supreme Court nominee that would have the ability to exonerate him. Yet, there are 26 senators that are still undecided. That’s unacceptable.

Here’s how you hold your members of Congress (and Trump) accountable:

• Democratic senators must speak up. It’s important to publicly oppose Kavanaugh ahead of the confirmation hearings coming up on September 4. There are still key Democrats that need to voice their position, like Senators Donnelly, Heitkamp, and Manchin. And Senator Schumer must especially work to whip the votes and keep Democrats together.
• Flip key Republicans. We still haven’t heard Senator Murkowski’s stance, and though Senator Collins is leaning “yes,” that doesn’t mean that there isn’t enough time to change her mind with strong constituent opposition. You can find our updated call scripts here and start making calls on Monday.

At this point you know the drill: another day, another breaking scandal about a corrupt member of President Trump’s inner circle. Yet Republicans want to let Trump make another lifetime appointment to the Supreme Court while he’s under active criminal investigation. Trump hasn’t even been president for two years yet, and these are some of the people he’s hired in the past couple years:

1. Campaign chairman Paul Manafort -- currently on trial for financial crimes
2. Campaign aide Rick Gates -- pled guilty
3. National security advisor Michael Flynn -- pled guilty
4. National security advisor George Papadopoulos -- pled guilty
5. EPA Administrator Scott Pruitt -- resigned in disgrace
6. Aide Omarosa Manigault-Newman -- breached security protocol in Situation Room and illicitly recorded colleagues

Again: that’s just a partial list, and that’s just from the past couple years. Yet Trump is someone we should trust to fill a lifetime appointment on the Supreme Court? After his lawyer said Trump would fight a subpoena from the Mueller investigation all the way to that very same Supreme Court?

Not on our watch.

Trump isn’t fit to make this lifetime appointment. Call Senators Senators John McCain and Jeff Flake now and urge them to take a stand against Kavanaugh’s illegitimate nomination before it’s too late.

Block and resist Kavanaugh's anti-environmental agenda

Brett Kavanaugh's long judicial record offers plenty of evidence of his extreme right-wing views, from his hostility to gun control and women's rights to his coziness with corporations to his frightening willingness to cede authority to the president.1 Kavanaugh's opposition to environmental protections, however, is especially well-documented. He is deeply opposed to the EPA's authority to protect our environment and health. In a number of high-profile cases, he has voted to limit or reverse EPA rules. Kavanaugh does not believe that the EPA even has the authority to regulate greenhouse gases without explicit approval from Congress.2 Given how Republicans in Congress have consistently prevented climate legislation, hobbling the EPA could mean blocking federal climate action entirely. Although Justice Kennedy's environmental record was mixed, he cast the deciding vote in the landmark 2007 case that found the EPA has the authority to regulate the greenhouse gases that cause global warming.3 As a judge with the U.S. Court of Appeals for the District of Columbia Circuit, Kavanaugh questioned that ruling in 2012 as part of his dissent against Obama-era greenhouse gas regulations.4 That vote is just one of many examples of Kavanaugh's long-running crusade against the EPA:5 In 2014, Kavanaugh opposed the EPA's mercury and air toxics rule for power plants. In 2015, he wrote a majority opinion tossing out the EPA's cross-state air pollution rule. In 2016, he ruled against the EPA's authority to regulate greenhouse gases. In 2017, he wrote the majority opinion against the EPA's authority to eliminated some uses of hydrofluorocarbons, which are potent greenhouse gases. When a future president tries to bring back the Clean Power Plan or directs the EPA to take any other action to address our rapidly warming climate, Kavanaugh could be the deciding vote on the Supreme Court to block it. We already know Kavanaugh's views. Any senator who gives him the power to act on them is supporting that future – one in which today's wildfires, floods, droughts and supercharged storms are far deadlier and more common. The Senate must have all of Kavanaugh’s records before holding hearings

Mitch McConnell wants to fast-track Brett Kavanaugh's nomination before October. That is an outrageous timeline. If McConnell gets his way, there will be no time to review the more than 1 million pages of documents from Kavanaugh's career, including important records from his time as White House staff secretary under George W. Bush. It is common practice to release these kinds of documents. The Senate reviewed all of Justice Elena Kagan's documents from her time in Bill Clinton's White House before confirming her. But Republicans are so committed to steamrolling this process and handing Trump the Supreme Court that they are opposing the release of Kavanaugh's records.1

Republicans don't want to release the records, so they are trying to downplay Kavanaugh's five and a half years as staff secretary in the George W. Bush White House. In that key role, he gave final approval to Bush's controversial "signing statements" that Bush used to circumvent laws passed by Congress, including laws about torture and national security.2 There is even a question of whether Kavanaugh lied under oath about his involvement in deciding Bush's torture policy during his confirmation hearing for the U.S. Court of Appeals for the District of Columbia Circuit in 2006.3

Kavanaugh has the longest paper trail of any nominee in history. It's one of the reasons Senate Majority Leader Mitch McConnell tried to discourage Trump from nominating Kavanaugh.4 It will take significant time to thoroughly review Kavanaugh's papers, and more controversy about his record is likely to emerge.

Earlier this month, two Republicans joined Democrats to block Circuit court nominee Ryan Bounds over his racist writings from college.5 If a judicial nominee's college writing matters, then Kavanaugh's career writing and his time as a key adviser to Bush absolutely must be examined before he is given a lifetime appointment to the highest court in the land. We have to pile on pressure to make sure that every member of the Senate – starting with the Senate Judiciary Committee – reviews all of Kavanaugh’s documents, emails and paperwork before the confirmation process continues.

Urge your senator to oppose Brett Kavanaugh’s nomination, because the President shouldn't be above the law

Foreign companies shouldn’t be able to spend money in our elections.

Supreme Court nominee Brett Kavanaugh doesn’t agree with that basic principle – and now a Russian company indicted in February as part of Special Counsel Mueller’s investigation is trying to use a decision written by Kavanaugh to get the case dismissed.

That’s just one of Kavanaugh’s extreme views on our democracy. He has written that he believes the president is above the law, he would give wealthy donors and corporations more power in politics, and he even upheld a discriminatory voter suppression law in South Carolina.

Momentum is building to oppose Kavanaugh, but we need to make sure senators know exactly why he’s unacceptable.

Here’s a suggested script for when you call:

“Hi, my name is _____ and I’m a constituent. I’m calling to ask Senator (NAME) to oppose Brett Kavanaugh’s nomination to the Supreme Court. I’m very concerned about his views on money in our elections, his belief that the president is above the law, and his past rulings on voting rights and foreign money. Please oppose his nomination. Thank you.”

Concord Management and Consulting was accused of failing to register as a foreign agent and report its election-related expenditures to the government. Now the company is using Kavanaugh’s decision in a case involving the Foreign Elections Campaign Act to try to get the case thrown out. Kavanaugh’s decision left the door open for unlimited spending by foreign groups on “issue advocacy” – ads that most people would consider election spending, but because they do not explicitly say to vote for or against a candidate, Kavanaugh’s narrow reading would allow them.

We don’t need a Supreme Court justice who sides with the wealthy and powerful over the rest of us. We don’t need a justice who was handpicked by the same wealthy special interests that are now spending millions of dollars to make sure he’s confirmed.

On Monday, Donald Trump revealed his Supreme Court nominee: Brett Kavanaugh, an extreme conservative judge who has argued that a sitting president cannot be indicted.1 The fight to keep the Senate from institutionalizing Trump's extremism for a generation is not going to be easy, but we have a path to win. And that path depends on Senate Democratic Leader Chuck Schumer. The only chance we have of stopping Kavanaugh's confirmation is for every single Democrat to hold the line against him. And not at the last minute when it's time to vote, but as a united Democratic caucus that proudly stands up for women, Muslims, immigrants, LGBTQ people, workers, voting rights and our planet and rejects Trump's takeover of the Supreme Court. Progressive champions like Sens. Jeff Merkley, Elizabeth Warren, Bernie Sanders and Kamala Harris have already voiced their strong opposition. Sen. Bob Casey, who is up for reelection in a state that Trump won in 2016, has unequivocally opposed him.2 But some like Sen. Tim Kaine have failed to take a clear stand.3. And others, like Sens. Joe Donnelly, Joe Manchin and Heidi Heitkamp, who voted to confirm Trump's first Supreme Court Neil Gorsuch, need more than just constituent pressure to keep them united with the caucus.4 We can win if pro-choice Republicans like Sens. Susan Collins and Lisa Murkowski reject Trump's anti-choice pick, or if Republicans who claim to respect our democracy reject Trump's attempt to put someone on the Supreme Court who could help him evade consequences from the Mueller investigation. But picking up Republican votes can only happen, and will only matter, if Sen.
