My letter to Senator Flake on his compromise regarding Kavanaugh's appointment: Sorry it doesn't go far enough

Dear Senator Flake,

Thank you for your compromise regarding putting a hold on voting on Kavanaugh to allow for an FBI investigation. I was very disturbed when I heard the news that you would vote along party lines to confirm Kavanaugh. While I believe that his sexual assault of Ms. Ford (and lying about it) certainly disqualifies him as a Supreme Court judge, there are even more important reasons to reject the appointment.

One of the responsibilities of Congress is to act as checks and balances so no president has so much power that he is above the law. I follow the daily scandals and corruption in the Trump administration and it is appalling to me that President Trump has not been impeached. This alone has wrecked the integrity of the Republican party. But to push through a Supreme Court candidate while the president is under investigation for several crimes is clearly wrong. I don’t have to remind you that the Republican party denied President Obama his right to select a Supreme Court judge, and his choice was a good compromise (being much less extremely partisan than Kavanaugh).

In his law-review article, Kavanaugh proposed that “Congress might consider a law exempting a President—while in office—from criminal prosecution and investigation.”

The idea that a sitting president is above the law is against our Constitution and everything this country stands for. President Trump has done his best to dismantle the checks and balances by hindering the ability of the press to hold him accountable, so all we have to protect our democracy is Congress. Now this hyper-partisan Congress is trying to push through an ultra-conservative judge with values that most Americans don’t share.

During the trial, Kavanaugh demonstrated that he can’t be objective by blaming the Democrats and the Clinton’s for this “witch hunt.”

While I appreciate you compromising by giving the FBI time to investigate, I feel that you have not gone far enough. It appears that that investigation has been limited. Of course it is vitally important that we don’t have a Supreme Court justice that refuses to take responsibility for his past sexual predator actions. But even his feeling of victimization would negatively affect his decisions on cases with rape victims.

According to the research presented in the scholarly paper, Gendered Justice: Women in the Criminal Justice System by Stephanie S. Covington & Barbara E. Bloom. “ Of the women in state prisons in 1998, 28 percent had been incarcerated for a violent offense (Bureau of Justice Statistics, 1999). Many of the violent crimes committed by women are against a spouse, ex-spouse, or partner, and the women committing such crimes are likely to report having been physically and/or sexually abused, often by the person they assaulted.” Often the women who kill their abusers (even in self defense) are sentenced by male judges who discriminate against them. You need to ask yourself if Kavanaugh could be objective in a case where a women kills her abuser. I believe he would not.

As a member of Congress, you have been given the sacred responsibility of upholding our Constitution and preserving our democracy. Please, vote no on Kavanaugh’s appointment to the Supreme Court and use any influence you have to convince the other Republicans (who aren’t blinded by party loyalty) to do the same.

My letter regarding Christine Blasey Ford's male interrogators on the Senate Judiciary Committee

Christine Blasey Ford will likely face intense questioning from Republicans on the Senate Judiciary Committee about the truthfulness of her accusations against Brett Kavanaugh, the Supreme Court nominee, who she says attempted to rape her during a party in the 1980s. Her turn on Capitol Hill could decide Kavanaugh’s suddenly uncertain fate, as well as the Supreme Court’s direction for a generation.1

Christine Ford will face questions from 11 Republican MEN on the Senate Judiciary Committee.

I just sent the following message to Sen. Senator Jeff Flake:

Dear Senator Flake,

It is bad enough that there are only Republican men on the Senate Judiciary Committee - especially since the issue of women's reproductive rights is at stake. Those men will never understand the prospect of risking their lives to have a baby or a back alley abortion. They will never face the threat of losing their livelihood because they become pregnant. If they did, they would not vote to allow insurance companies to stop paying for the pill or support bills that allow companies to fire pregnant women - like several congressmen have.

Senator Flake, it is entirely inappropriate that Christine Blasey Ford face intense questioning from eleven men on the Senate Judiciary Committee about the truthfulness of her accusations that Brett Kavanaugh attempted to rape her. Men cannot begin to understand the sexual trauma Ford claims to have suffered at Kavanaugh’s hands, or how that trauma has affected her throughout her adult years. Senator Hatch has already dismissed Ford as potentially “mixed up” in the charges she’s made.

How to stand up to Trump Collusion and oust Kavanaugh

This Week in Trump Collusion” timeline:

→ Tuesday: Former Trump campaign chairman Paul Manafort was found guilty on charges of bank and tax fraud. THEN former Trump attorney Michael Cohen pled guilty to campaign finance violations.
→ Wednesday: The revelations on the Cohen investigation prompted Democrats to call for a delay on the confirmation process for Trump’s Supreme Court nominee Brett Kavanaugh. And New York state investigators issued a subpoena to Cohen as part of their investigation into the Trump Foundation.
→ Thursday: We found out that National Enquirer publisher David Pecker received immunity from federal prosecutors for providing information on the Trump and Cohen hush money investigations. After Trump threw a Twitter tantrum, and called Paul Manafort a “brave man,” it was reported that Trump is considering a pardon for Manafort (reminder: this is a big, glaring red line and we’ll be ready).
→ Hours before we wrote this email: News broke that Trump organization finance chief, Allen Weisselberg, would be granted immunity in the Cohen investigation as well.

Bottom line: Even before the continuing drip-drip of collusion, there were plenty of reasons for your senators to oppose Kavanaugh based on his record.

Brett Kavanaugh's record shows that he is willing to protect Trump from accountability for his corruption and crimes, dismantle environmental protections, and side with the wealthy and powerful over working people. 

Now, there’s no excuse for inaction. We know that Brett Kavanaugh does not believe a sitting president can be indicted, or should even be investigated. It’s clear that Trump engaged in criminal activity during the campaign, and he chose Kavanaugh in order to shield himself from accountability when the Supreme Court inevitably weighs in on Trump’s crimes and corruption.

That’s why it is imperative that we stop Kavanaugh now. Trump has hand-picked the Supreme Court nominee that would have the ability to exonerate him. Yet, there are 26 senators that are still undecided. That’s unacceptable.

Here’s how you hold your members of Congress (and Trump) accountable:

• Find out where your senators stand on Kavanaugh. Our policy team has put together a handy tracker to find out whether your senator has publicly opposed, supported, or is on the fence. If you want to go the extra mile, there are even judiciary staff contacts for each senator listed in the tracker that you can email to voice your opposition!
• Democratic senators must speak up. It’s important to publicly oppose Kavanaugh ahead of the confirmation hearings coming up on September 4. There are still key Democrats that need to voice their position, like Senators Donnelly, Heitkamp, and Manchin. And Senator Schumer must especially work to whip the votes and keep Democrats together.
• Flip key Republicans. We still haven’t heard Senator Murkowski’s stance, and though Senator Collins is leaning “yes,” that doesn’t mean that there isn’t enough time to change her mind with strong constituent opposition. You can find our updated call scripts here and start making calls on Monday.

Let’s keep our eyes on what’s important

On weeks where the news is chaos (or pretty much a dumpster fire), it’s important for us to not get distracted. There’s only one way to make sure that these fights stop coming down to the wire -- Vote. Them. Out. At this point you know the drill: another day, another breaking scandal about a corrupt member of President Trump’s inner circle. Yet Republicans want to let Trump make another lifetime appointment to the Supreme Court while he’s under active criminal investigation. Donald Trump cannot appoint a Supreme Court justice who could vote to protect him from the investigations into his potential collusion with Russia and other crimes.

This appointment is a loser for democratic legitimacy. Democrats must stand together to oppose it, and at least one Republican must join them.

Trump hasn’t even been president for two years yet, and these are some of the people he’s hired in the past couple years:

1. Campaign chairman Paul Manafort -- currently on trial for financial crimes
2. Campaign aide Rick Gates -- pled guilty
3. National security advisor Michael Flynn -- pled guilty
4. National security advisor George Papadopoulos -- pled guilty
5. EPA Administrator Scott Pruitt -- resigned in disgrace
6. Aide Omarosa Manigault-Newman -- breached security protocol in Situation Room and illicitly recorded colleagues

Again: that’s just a partial list, and that’s just from the past couple years. Yet Trump is someone we should trust to fill a lifetime appointment on the Supreme Court? After his lawyer said Trump would fight a subpoena from the Mueller investigation all the way to that very same Supreme Court?

Not on our watch.

Trump isn’t fit to make this lifetime appointment. Call Senators Senators John McCain and Jeff Flake now and urge them to take a stand against Kavanaugh’s illegitimate nomination before it’s too late.

We still have time left to turn the tide in the Senate against Brett Kavanaugh’s illegitimate nomination -- but not much. Hearings start after Labor Day.

The Senate must have all of Kavanaugh’s records before holding hearings

Tell the Senate: "Release and review all documents, emails and paperwork associated with Brett Kavanaugh before proceeding with his Supreme Court confirmation process."

Mitch McConnell wants to fast-track Brett Kavanaugh's nomination before October. That is an outrageous timeline. If McConnell gets his way, there will be no time to review the more than 1 million pages of documents from Kavanaugh's career, including important records from his time as White House staff secretary under George W. Bush. It is common practice to release these kinds of documents. The Senate reviewed all of Justice Elena Kagan's documents from her time in Bill Clinton's White House before confirming her. But Republicans are so committed to steamrolling this process and handing Trump the Supreme Court that they are opposing the release of Kavanaugh's records.1

Republicans don't want to release the records, so they are trying to downplay Kavanaugh's five and a half years as staff secretary in the George W. Bush White House. In that key role, he gave final approval to Bush's controversial "signing statements" that Bush used to circumvent laws passed by Congress, including laws about torture and national security.2 There is even a question of whether Kavanaugh lied under oath about his involvement in deciding Bush's torture policy during his confirmation hearing for the U.S. Court of Appeals for the District of Columbia Circuit in 2006.3

Kavanaugh has the longest paper trail of any nominee in history. It's one of the reasons Senate Majority Leader Mitch McConnell tried to discourage Trump from nominating Kavanaugh.4 It will take significant time to thoroughly review Kavanaugh's papers, and more controversy about his record is likely to emerge.

Earlier this month, two Republicans joined Democrats to block Circuit court nominee Ryan Bounds over his racist writings from college.5 If a judicial nominee's college writing matters, then Kavanaugh's career writing and his time as a key adviser to Bush absolutely must be examined before he is given a lifetime appointment to the highest court in the land. We have to pile on pressure to make sure that every member of the Senate – starting with the Senate Judiciary Committee – reviews all of Kavanaugh’s documents, emails and paperwork before the confirmation process continues.

Urge your senator to oppose Brett Kavanaugh’s nomination, because the President shouldn't be above the law

Foreign companies shouldn’t be able to spend money in our elections.

Supreme Court nominee Brett Kavanaugh doesn’t agree with that basic principle – and now a Russian company indicted in February as part of Special Counsel Mueller’s investigation is trying to use a decision written by Kavanaugh to get the case dismissed.

That’s just one of Kavanaugh’s extreme views on our democracy. He has written that he believes the president is above the law, he would give wealthy donors and corporations more power in politics, and he even upheld a discriminatory voter suppression law in South Carolina.

Momentum is building to oppose Kavanaugh, but we need to make sure senators know exactly why he’s unacceptable.

Call your senators now at (202) 224-3121 and ask them to oppose Kavanaugh’s nomination because of his extreme views.

Here’s a suggested script for when you call:

“Hi, my name is _____ and I’m a constituent. I’m calling to ask Senator (NAME) to oppose Brett Kavanaugh’s nomination to the Supreme Court. I’m very concerned about his views on money in our elections, his belief that the president is above the law, and his past rulings on voting rights and foreign money. Please oppose his nomination. Thank you.”

Concord Management and Consulting was accused of failing to register as a foreign agent and report its election-related expenditures to the government. Now the company is using Kavanaugh’s decision in a case involving the Foreign Elections Campaign Act to try to get the case thrown out. Kavanaugh’s decision left the door open for unlimited spending by foreign groups on “issue advocacy” – ads that most people would consider election spending, but because they do not explicitly say to vote for or against a candidate, Kavanaugh’s narrow reading would allow them.

We don’t need a Supreme Court justice who sides with the wealthy and powerful over the rest of us. We don’t need a justice who was handpicked by the same wealthy special interests that are now spending millions of dollars to make sure he’s confirmed.

On Monday, Donald Trump revealed his Supreme Court nominee: Brett Kavanaugh, an extreme conservative judge who has argued that a sitting president cannot be indicted.1 The fight to keep the Senate from institutionalizing Trump's extremism for a generation is not going to be easy, but we have a path to win. And that path depends on Senate Democratic Leader Chuck Schumer. The only chance we have of stopping Kavanaugh's confirmation is for every single Democrat to hold the line against him. And not at the last minute when it's time to vote, but as a united Democratic caucus that proudly stands up for women, Muslims, immigrants, LGBTQ people, workers, voting rights and our planet and rejects Trump's takeover of the Supreme Court. Plan to stop Brett Kavanaugh

The fight to #SaveSCOTUS from Trump’s next Supreme Court Justice nominee is no longer speculative. Last night, Trump announced his nomination to replace Justice Anthony Kennedy on the Supreme Court: Brett Kavanaugh. (Click here to read our latest resource on why Kavanaugh should be stopped.)

Kavanaugh is one of the most cravenly partisan choices Trump could have made. He’s been called the “Forrest Gump of Republican politics,” as he seems to always show up in high-stakes, far-right political battles and conspiracy theories. In fact, his “excessive partisanship” delayed his confirmation to the DC Circuit in 2003 by not one, not two, but three years, and only then passed by a 57 to 43 vote. His long, partisan history even had Mitch McConnell scrambling to encourage Trump to make another pick just three days ago. We. can. win. this.

We’ve teamed up with with MoveOn, Demand Justice, NARAL Pro-Choice America, Ultraviolet, National Center for Transgender Equality, United We Dream, Planned Parenthood Action Fund, CREDO, and other national progressive organizations to call for a week of action to #SaveSCOTUS.

Yesterday, we kicked off our week of action with in-district visits across the country. Outlined in our 2-Step Strategy to Win the Supreme Court Fight, the only way we can defeat Trump’s nominee is to make sure every single senate Democrat (and likely two Republicans) commits to a ‘no’ vote. All eyes will be on this nominee -- and the response from grassroots activists like you. No senator will be able to lay low on their position. That makes this -- today, tomorrow, all week long -- the perfect moment to begin pressuring our senators to make the right decision and commit to opposing Kavanaugh.

This is just the beginning. There are will be many flashpoints in the weeks ahead where we’ll need to be all hands on deck. We’ll be fighting tooth and nail to keep this extreme nominee from being seated on the court. Using the same grassroots opposition that stopped TrumpCare in spite of impossible odds, we will make it clear to both Democrats and Republicans that a ‘yes’ vote for Brett Kavanaugh is a vote to gut our rights and undermine our democratic institutions.

Instead of providing a needed check on Donald Trump’s most dangerous and xenophobic impulses, five Supreme Court justices just handed him a blank check to discriminate against Muslims.1 The Supreme Court's decision to uphold Trump's Muslim ban threatens the core principles of our democracy and could help supercharge Trump's broad attacks on Muslim communities. Click here to sign the petition. Trump’s Muslim ban is appalling, horrifying and unconstitutional. It illegally discriminates against immigrants based on their country of origin by targeting people born in five Muslim-majority countries including – Iran, Libya, Somalia, Syria and Yemen – and people born in North Korea and Venezuela. The ban prohibits people from these countries from traveling to the United States and bars many of them from ever qualifying for a green card or work visa.2,3 Sen. Chris Murphy and Rep. Judy Chu have introduced legislation to overturn this racist policy.4 The bill would withhold any funding to enforce the Muslim ban and declares it illegal based on the 1965 Immigration and Nationality Act, which prohibited discrimination against immigrants on the basis of national origin. Similarly, Sen. Dianne Feinstein has introduced two bills to block the ban. One would rescind Trump's Muslim ban executive order and the other would amend the 1965 Immigration and Nationality Act to restrict the president’s authority to bar people from entering the United States.5 Trump's Muslim ban comes from the same racism that allows him to rip families apart and terrorize immigrant communities. To protect immigrants, refugees and their families, we need to push our elected officials in Congress to fight back. We have to demand that they use their power to block Trump's hateful agenda.
